Terms of Use

1. About Rakachel

Rakachel is an AI-powered content production and workflowservice designed to help businesses and marketing teamscreate, manage and organise content.

Rakachel may use third-party artificial intelligence,software, hosting, communication, payment and othertechnology providers to deliver parts of the service.

2. Your Account

You are responsible for providing accurate information whencreating your account and for keeping your account credentialssecure.

You are responsible for activity carried out through youraccount and should notify us promptly if you believe youraccount has been accessed without your permission.

3. Your Content

You remain responsible for the information, instructions,documents, brand material and other content that you provideto Rakachel.

You must have the necessary rights and permissions to providecontent to Rakachel and to use that content for your intendedpurposes.

4. AI-Generated Content

Rakachel uses artificial intelligence to assist with contentcreation and related tasks.

Rakachel does not guarantee that every AI-generated outputwill be accurate, complete, original, suitable for a particularpurpose or free from errors.

5. Third-Party AI Services & Usage Charges

Rakachel may connect with or use third-party AI and technologyproviders, including services such as OpenAI, Anthropic/Claude,Google or other providers.

These charges may include API fees, token or usage fees,subscription fees, credits, storage fees or other usage-basedcharges imposed by the relevant third-party provider.

If a particular Rakachel package includes third-party AI usage,credits or allowances, the applicable offer or subscriptionwill state what is included and any applicable limits.

Third-party providers may change their pricing, availability,limits or terms independently of Rakachel.

6. Payments

Payments for Rakachel services may be processed throughPaystack.

When you make a payment, your payment information may beprocessed by Paystack in accordance with Paystack's applicableterms and privacy policies.

Rakachel does not store your full card details where thosedetails are handled directly by the applicable payment provider.

7. Subscriptions & Renewals

Where you purchase a recurring Rakachel subscription, thesubscription price, billing frequency and applicablecancellation terms will be shown before purchase.

You may cancel your subscription using the cancellationmethod provided to you or by contactingsupport@rakachel.co.za.

Cancellation will normally apply to future billing periods,subject to the terms of the offer you purchased and applicablelaw.

8. Refunds

Refunds, where applicable, will be handled according to thespecific offer, subscription terms and applicable South Africanconsumer law.

Nothing in these Terms is intended to remove or limit aconsumer right that cannot lawfully be excluded.

9. Service Availability

We aim to keep Rakachel available and functioning reliably,but we cannot guarantee uninterrupted or error-free service.

Availability may be affected by maintenance, internet failures,third-party service outages, AI provider outages, paymentprovider outages or circumstances outside our reasonable control.

10. Acceptable Use

You agree not to use Rakachel for unlawful, fraudulent,abusive or harmful purposes.

You must not attempt to interfere with the security or operationof the service, gain unauthorised access to systems, or useRakachel in a manner that violates applicable law or the rightsof others.

11. Intellectual Property

Rakachel's software, branding, interface, systems and underlyingtechnology remain the property of Rakachel or its applicablelicensors.

Your pre-existing business materials, trademarks, logos andother content remain yours or belong to their respective owners.

Subject to these Terms and applicable third-party restrictions,you may use content produced for you through Rakachel for yourbusiness purposes.

12. Limitation of Liability

To the extent permitted by law, Rakachel will not be liable forindirect, incidental, special or consequential losses arisingfrom the use of the service.

Nothing in these Terms excludes or limits liability where doingso would be unlawful, including rights that cannot legally beexcluded under applicable consumer protection or other legislation.

13. Changes to the Service or Terms

We may update the service and these Terms from time to time.Where changes materially affect your rights or obligations,we will take reasonable steps to notify you.

14. Governing Law

These Terms are governed by the laws of the Republic ofSouth Africa, subject to any mandatory rights or protectionsapplicable to you.

19. AI Providers

Where Rakachel uses third-party artificial intelligence services,information supplied to those services may be processed accordingto the applicable provider's terms, privacy policy andconfiguration.

You should not submit highly sensitive personal information,confidential information belonging to another person, orinformation that you do not have permission to process.

Where your Rakachel configuration requires you to connect yourown third-party AI account or API account, you are responsiblefor reviewing and complying with that provider's terms andprivacy requirements.

20. Payments & Paystack

Payments may be processed by Paystack. Payment information maytherefore be collected and processed by Paystack in accordancewith its own privacy policy and applicable requirements.

We may receive information necessary to confirm and administeryour transaction, such as payment status, transaction referenceand relevant customer details.

21. Cookies

Rakachel may use cookies and similar technologies to operate thewebsite, remember preferences, understand website usage, improveperformance and support analytics or marketing.

You can manage cookies through your browser settings. Disablingcertain cookies may affect some website functionality.

22. Data Security

We take reasonable technical and organisational measures designedto protect personal information against unauthorised access,loss, misuse, alteration or disclosure.

However, no internet-based service can guarantee absolute security.

23. How Long We Keep Information

We retain personal information for as long as reasonably necessaryfor the purposes described in this Privacy Notice, to provide theservice, resolve disputes, maintain appropriate business recordsand comply with applicable legal obligations.

Subject to applicable law, you may have rights relating to yourpersonal information, including the right to request access topersonal information, request correction of inaccurate information,object to certain processing, or request deletion where legallyapplicable.
